Golden Hill Maintenance Assessment District disposition impacts

As you know, the September 22, 2011, disposition from the State of California Court of Appeal, Fourth Appellate District regarding litigation between the City of San Diego and the Golden Hill Neighborhood Association, Inc. has directed the trial court to vacate the City Resolution forming the Golden Hill Maintenance Assessment District.

Many of our constituents are concerned about the potential immediate and lasting impacts that may result from this action.

To better understand the effects of this disposition, we ask that you fully review it and specifically address the following questions:

Is this disposition appealable? What impact will this have on the General Fund?
What is the expected timeline for actions and implementation associated with this disposition?
Will property owners receive any reimbursements from previous assessments paid into the district? What impact will this have on the General Fund?
Will residents be assessed for this fiscal year?
What effects will this disposition have the district's current contractual obligations?
How will the district's maintenance operation obligations, such as graffiti and litter removal, collection of refuse containers, 32"' Street canyon restoration, sidewalk planter maintenance, tree trimming and light pole banner maintenance be performed this year and in the future?

Although this disposition has moved us closer to resolution on these issues, many questions remain. In order to address the concerns of our constituents, we respectfully request that you advise us on this matter as soon as possible.
